1. Acceptance of Terms

By accessing or using Nuva (“the Service”), provided by Nuva (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Description of Service

Nuva is an AI-powered medical information platform that provides conversational AI assistance through specialized agents. The Service includes: a pharmacist AI assistant for medical information and drug guidance; drug dosage calculators for general, pediatric, and neonatal populations; a skincare advice agent; a lab results interpretation agent; multi-language support (English, Kurdish Sorani, Kurdish Badini, Kurdish Latin, and Arabic); voice input/output capabilities; and image/file attachment processing. The Service is available on the App Store (iOS), Google Play (Android), and as a web application at nuva.krd.

3. Account Registration & Authentication

Access to Nuva requires authentication via Google Sign-In. By creating an account, you agree to:

  • Provide accurate information when completing your profile, including your display name and professional designation.
  • Maintain the security of your Google account credentials. You are responsible for all activity under your Nuva account.
  • Notify us if you suspect unauthorized use of your account.

During registration, you select a professional designation (e.g., Doctor, Pharmacist, Nurse, Medical Student, Non-medical). This information is used for personalization and is stored in your profile.

4. User Responsibilities

By using Nuva, you agree to:

  • Use the Service in compliance with all applicable laws and regulations.
  • Not use the Service for illegal, harmful, abusive, or fraudulent purposes.
  • Not attempt to reverse-engineer, decompile, or exploit the Service or its underlying systems.
  • Not transmit malware, spam, or any content that could harm the Service or other users.
  • Not circumvent rate limits, authentication mechanisms, or other security measures.
  • Independently verify all drug dosages, medical information, and clinical recommendations before any clinical use.

5. AI & Medical Limitations Disclaimer

NUVA IS NOT A MEDICAL DEVICE. All AI agents provide informational responses only. You acknowledge and agree that:

  • The pharmacist AI agent provides general medical and pharmaceutical information. It cannot replace a licensed pharmacist, physician, or other healthcare professional.
  • Drug dosage calculators (general, pediatric, and neonatal) provide calculated values that must be independently verified by a licensed healthcare professional before administration to any patient.
  • The Skin Care Agent provides general dermatological information and cannot diagnose skin conditions. It is not a substitute for consultation with a dermatologist.
  • The Lab Results Agent provides general interpretive information about laboratory values. It cannot provide clinical diagnoses and is not a substitute for a physician's interpretation.
  • AI responses may produce inaccurate, incomplete, or outdated information despite built-in fact-checking and reasoning mechanisms.
  • You must never rely solely on Nuva for decisions involving patient care, health, safety, or any clinical matter.
  • Nuva is intended as a learning, drafting, and reference tool — not as a primary source of clinical authority.

6. Content & Usage Rules

You retain ownership of the content you submit to Nuva (text messages, images, voice recordings, and file attachments). By using the Service, you grant us a limited license to process your content solely for the purpose of providing the Service, including processing it through our AI to generate responses. You agree not to:

  • Submit content that is illegal, defamatory, threatening, or infringes on others' rights.
  • Submit protected health information (PHI) of third parties without proper authorization.
  • Use AI-generated drug dosages or medical information for direct patient care without independent verification by a licensed professional.
  • Redistribute, resell, or commercially exploit AI-generated content without authorization.

When you share a conversation publicly via the sharing feature, the shared content becomes accessible to anyone with the link. You are responsible for ensuring shared conversations do not contain sensitive or confidential information.

7. Service Limits

The Service enforces the following operational limits:

  • Rate limiting: Requests are limited per minute to ensure fair usage and platform stability.
  • Chat storage: A maximum of 15 active chats per user. Creating additional chats will automatically remove the oldest.
  • Message limits: Each chat retains the last 20 messages. Only the last 12 messages are sent to the AI for context.
  • Request size: File uploads and attachments are limited to 10 MB per request.
  • Voice recording: Limited to 2 minutes per recording.

8. Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if:

  • You violate these Terms of Service.
  • Your use of the Service poses a risk to other users or the platform.
  • You engage in abusive, fraudulent, or illegal activity.
  • Required by law or regulatory authority.

You may request deletion of your account by contacting support@nuva.krd. Upon account deletion, all associated data (profile, chats, shared chats) will be permanently removed in accordance with our Privacy Policy.

9. Intellectual Property

The Nuva name, logo, software, design, AI models, and all related intellectual property are owned by Nuva and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent. The AI reasoning engine, agent configurations, and underlying technology architecture are proprietary and confidential.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NUVA AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, NUVA SHALL NOT BE LIABLE FOR ANY HARM, INJURY, OR DAMAGE ARISING FROM RELIANCE ON AI-GENERATED MEDICAL INFORMATION, DRUG DOSAGE CALCULATIONS, OR ANY OTHER HEALTH-RELATED CONTENT PROVIDED BY THE SERVICE. YOU ASSUME FULL RESPONSIBILITY FOR INDEPENDENTLY VERIFYING ALL SUCH INFORMATION WITH QUALIFIED HEALTHCARE PROFESSIONALS.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Indemnification

You agree to indemnify, defend, and hold harmless Nuva and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, your reliance on AI-generated content for clinical purposes, or your violation of any third-party rights.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kurdistan Region of Iraq. Any disputes arising from or relating to these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the competent courts in the Kurdistan Region of Iraq.
